Cheque dishonour case clarification

I have booked a new vehicle with one of the auto consultant and paid the full money of Rs.56,000/-.He delayed the delivery and I asked him to return the money,he gave me current account (OD) cheque and the same was dishonoured due to insufficient money.Mean time that guy closed the shop and up scanded,now I filled the case against 138NI Indian act.I dont know where he is residing and not able to contact.I would like to know is there any options to recover the money through his property,etc... or it is only waste of time and I need to compromise my self.Please help.

  1. It is very sad that many news are coming about drug use prison and most of them are children. Here, one thing is clear that, if atmosphere is not clean no one will be safe there these types of accident will always take place. The news also says that most the teens are using <A HREF=http://www.edrugrehabs.com/>drug and alcohol</A> that is very bad sign.


  2. when you dont know where he is or where he resides, u cant do abything about it. Lodge an FIR with the police and hope that they can trace this person

  3. first you have to get order to affix court summons at his resident u/s.63-64 of Cr.P.C. and then after apply for warrant and then file an pllication u/s.82 of Cr.P.C. for declare him absconder and attech his properties by court order.
