Question:

Chicken bone in my Chicken Subway Can I sue?

Today I was eating at Subway and I had a oven roasted chicken breast sandwich. While eating it I realized that their was a bone. I then left the restuarant and I had EMS drive me to the local hospital. I punctured something down my throat and now I need treatment. Can I sue Subway for this?

  1. You could try but you won't be successful based on the circumstances you describe.


  2. Yes.  You can sue.  But, unless it caused you serious permanent injury and to have high medical bills, I doubt you would find a lawyer willing to take this case.  

    Just because someone made a mistake, doesn't mean you have to sue them.

    Oh, and they should have a medical payments coverage in their liability policy.  Its usually around $2K to $5K and it can cover all or most of your bills.

  3. Ok Here is the thing. Did you happen to mention it to a manager or someone in the (store) restaurant. If so yes there is a possibility. If not then your chances are not good, yeah I kow I heard about the lady with the hot coffee and McDonalds. She won, at least that is what I heard. I found a staple in a salad once . yep I showed them yep they believed me. They did talk to the person about being more careful and offered to pay my bill. No I didn't let them, no it didn't do damage, thank goodness. My point is , it is 50% 50% . Good luck whichever you do.One way or another

  4. The answer is NO - if its a natural food item, no you cannot sue. If the item that you choked on is not a natural food item, like glass, plastic, metal, etc then you CAN sue.

    So just chew you food wisely before you eat. Sueing is not that easy...
