Child Custody Battle: Are they serious?

Hello everyone.

I have a sister who is turning 27 years old. She has three children to two different men. Her oldest child is a 7 year old boy, which once he was around 5 years old, she tried to kidnap him from the Grandmother who cared for him since he was born.

Her second child, a 5 year old girl, has been with my family since birth. My parents have Guardianship over her, and you guessed it. Just this year, my sister tried to kidnap her. My parents did not press charges, to avoid conflict - although now, I think they should have.

My sister is trying to gain custody of my neice now, who has spent all her life with us. My sister has been in trouble with the police since she was 12 years old. She has been caught drinking and driving, driving without a license (and is going to jail for that this year), doing/selling/growing drugs, and more.

In Pennsylvania, apperently if you are the birth mother, you automatically gain. All of these things in her past, they are not using

  1. You need documentation of all these things.  You need to be able to prove to the court that she is unfit to care for the child.  Consult an attorney and see what constitutes unfit in your state.  You may have to have someone follow her and document her activities, you may need pictures, etc.  Drug activity usually equals unfit in every state, so if you can document that and that it's recent you should retain custody.


  2. Hire a lawyer and go after her rights fully...

    Tell them "it is not in the best interest of the children for the mother to have them"

  3. Hire a good lawyer NOW and fight for full custody. Do not give up, you are her lifeline.

  4. I think the she clearly is not capable of taking care of her children. Not to mention that if she really wanted to be a good parent she would stop living like she is and make an effort to be a good parent to her children.
