Child Custody California- Ex lives cross country and is moving 450 miles away in state. Common distant arrang?

Ex left child at young age and barely visited until 2 years ago and was granted visitation. I live in Monterey and she lives in Fl however she is moving to San Diego. Im curious as to how much more visitation she will get living closer or if she will be able to get joint physical. Does anyone currently have court ordered custody arrangements over distance within the state of california? If so what are they? Are there any family lawyers who can tell me typically what happens with distant in state arrangements?

  2. Unless there is a valid reason not to:  They can get as much visitation as they want as long as it does  not overly interfere with regular activities.

    I would think all summer, Most of Xmas and Spring Vacation.

    I suggest your encourage as much visitation as possible.  Remember, this is about the child, not you.

  3. Joint physical custody would probably not be awarded for a school age child because it would be impossible to come up with a 50/50 schedule that accomodates the school calendar.  Not in the best interest of the child.

    As for increased visitation, that's possible, now that it is easier for the ex to travel to you and for the child to travel to her.  Frequent contact with both parents is usually preferred as being in the best interest of the child.

    Try to work it out without a lot of drama - in the best interests of the child.

There really isn't a "typical" situation.  They're all different.  How much visitation was she granted?  How much is she seeking now?  How old is the child?  Does the child have established roots in your community (friends, school, etc.)  Talk to a lawyer about your specific situation to get better advice.

    I agree with the other poster:  joint physical probably won't happen.  My husband and his ex divorced in California and she was given physical custody and moved out of state.  He still kept every other weekend; every school break and most of the summer but then again, he negotiated that from the beginning.
