Child Support and going back to school...?

What happens to my child support if I want to finish my college education?

I have a daughter who is 5 years old. I have been working the whole time and recieving support from her father. Recently, I have an awesome opportunity to finish my college education and better myself. I do not have to work except for maybe a small part-time job on the side and finish up the last two years of my college education. I have been wanting this for so long. The only thing, I am concerned about is that my daughter's father will try to object to it in some way and I won't be able to go. He's kind of like that. I mean, yes, my income will drop significantly, but I will not be "not working" because of anything bad. I am trying to better myself for me and for my daughter. When I get out, I will be able to make a lot more money - and it's only two years away.

So I guess I am just wondering - is there a way he can object to me going back to school because the support payments might end up changing?

  2. you not working should not change the payments that is your choice. The only time that is a factor is if you were married and a stay at home mom then he is required  to keep you at that life style for   a few years till you get a job.  YOu not working now is a  choice you make the payments only go up if he gets a raise and you  go back to court.  Our if you are doing 50/50 parenting and you try and win sole custody then.  The payments are for the childs care not for your care.  YOu wil have to work and go to school if you want to do it.

Do what's right for you, and don't worry about him.  If he objects he won't have a legal foot to stand on.  Trust me I have been there and he tried that.  Your child support should change and you should request a child support review as soon as you start school.  His child support will go up, but after all it's only for two years then he should get a significant decrease because of your great new career.  After all didn't you support him in some way, form, or fashion?  Go to school girl this opportunity may not come around again.

  4. support payments won't change unless you or he request an evaluation by the local child support office or you /he hires an attorney to get it changed.  They don't monitor your wages it is pretty much up to either party if there is a change in circumstance to get it modified.

Well, for one the support arrangements will never change unless this is taken back to court.  For another if he objects to this making life better for yourself and his daughter then he is nuts.  But do not expect an increase in support if you drop your work time down and go to school the rest of the time because his support is based solely on his income and only if that changes will the courts raise or lower the payments accordingly.  My best advice is to ask a lawyer about this but from experience of a friend...support never raises when you do not work and do other things to help yourself.  She had to go back to court to get it raised when she found out he had gotten a job where he was making a lot more than he had been.

    But what Amber fails to remember each state goes on percentage of the other parent's income based on the scale set.  And it does not change most likely if the mother is not working.  I know this because my best friend is not working and it did not go up for a few years because she had no job.  She has had to stay home with a child who has a genetic disorder and he is in the hospital a lot for treatments.  He has only had his childsupport looked into once to raise it after his own income raised quite a lot.  So I would ask a lawyer about it first.  There are some states that do not change the support because the mother or father who recieves the support for the kids is not working as much or has decided to go to school to improve their situation.
