My sons father hasn't paid child support in about 7 months. I want to give him a choice either sign your rights over and you wont own me a dime or stop visitations until your child support is paid in full..has anyone ever heard of this being accomplished? As far as I know hes not working either. Help!

  1. well if he isnt working that explains the non payment doubtfull he will sign over his rights   visitation is a whole seperate issue   he can see the child as court ordered visitation allows it has nothing to do with if he is current with support payments

  2. He can not relinquish his obligation to provide support, you can not with hold visitation because he is behind in support.

File a contempt of court motion with the court to enforce the back due support.

"Iv been told by my lawyer that I can stop visitations if I wanted." - I suspect you misunderstood your lawyer. You can petition the court to modify the child custody order to revoke visitation, however as long as a court order exist that orders visitation you can't simply violate that order.

  3. Consult your local attorney, so you can get legal advice, and win the case you want.

  4. He cannot sign away his rights unless you hae someone who is willing to adopt him.

    Get his wages garnished.
