My son, is 15 and he stayed with my ex for the summer .

TODAY after 8 weeks i was planning to pick him UP.

HE sad no so i called the Police they came, but they sad we can only say you need to go home to your mom, but they cant help me if he does not want to come with me. Florida law says that they can only ask him to go home otherwise thats it i have primary custody my ex has only visitations rights so i don't understand the law why they coul`d not help me with that .

  1. You can take the mom to court for violating the court order, but since the child is 15, they will probably allow him to state where he wants to live unless there are unacceptable circumstances.

  2. yo son needs to come home he has no say so in what you tell him to do..... he probably only wants to stay down there more b\c his father is letting him do things you wouldnt let him do  

  3. I am not sure about FL law, but I know here in Maine, once the child is 14, all prior custodial rights amount to nothing because the minor can decide which parent they choose to reside with.

  4. in some states if a child is 15 they can choose where they live no matter if there is a custody order
