  1. To be emacipated from ones parents in California is difficult to do.  The teen would need to be able to support themself without the parents help.  That means they either need a job or a pretty big trust account.  This is because the state does not want to remove resonsibility of the parents only to have to take care of the teen.  If the teen could not self support the teen would likely be placed into a foster care home.

There also needs to be very serious neglect, abuse, or someother horrible things going on in the home.  There must be some reason to remove the teen form the home.

It does not happen often because it is difficult to do the way your friend mayt want it to work.  Depending upon the state you live in (assuming USA) the state laws would set the rules for the procedure.

  2. Do you mean "emancipate"? It is possible, but it isn't a simple task.

How does a minor become emancipated?

A petition for emancipation must be filed with the court. Several factors will be taken into consideration including the minor's age, marital status, source of income, housing and ability to be self-supportive. After careful consideration the decision will be made by a judge. A lawyer is not necessary when filing a petition for emancipation but if one prefers to have an attorney present legal counsel can be helpful. It is important to note that different states and even counties have various procedures for filing a petition for emancipation. You may consult a legal representative or contact your local courthouse for information concerning the procedures in your area.

We've examined some of the questions that people ask about emancipation but one question remains. Should you emancipate your teen? Only you, the parent can answer that question. The answer will depend on the unique circumstances that brought the idea of emancipation into question in the first place. Talk to your teen openly and honestly. Discuss your feelings and allow your teen to express his or her feelings freely. If you feel you need outside help to solve a problematic situation seek the help of a professional counselor or legal representative to decide whether emancipation is the best course of action in your particular situation. Ultimately the decision to emancipate your teen should be one that is in everyone's best interest, especially your minor child.

  3. of course...all she has to do is call DCYF on her parents...although, then the state gets involved and u end up in foster care which can sometimes be worse than ur own parents....pretty much she has 3 more years til she can get papers signed to get emancipated from her parents.

  4. hmm. Not sure if that has ever been done but any child can become emanciped from their parents. But you would need to hire a lawyer for that and it can be VERY expensive.  This child may be best served by speaking to a teacher or trusted adult to help them with this problem.
