Child support, but daddy isnt working?

if the father of ur kids isnt working, and u file for child support....will u still recieve something and how?

  1. depends on the state i know ohio pays you and then he owes the state


  2. you won't receive anything if his income is zero, but you should still file now.  That way, when he does get a job/tax return, you will receive support.

  3. You probably won't receive something.... But the judge will most likely still assign him an amount to pay every month.  

    And when he doesn't pay that amount as he's supposed to, he will start receiving consequences, usually starts with suspending drivers licensces, then denying state/govt benefits, then possibly brought back to court and possibly being thrown in jail.

    However, I've noticed that some states actually pay the child support for the man and then the man owes the state the support.  Check your state laws, you could possibly be in one of those states.  (My state doesn't do it that way though... VA).

  4. You won't receive anything from him if he's not working, but you can apply for welfare.  He may have to repay the state when he starts work again.

  7. I think it depends on your state but I think they will give you some $$ and garnish his wages when he starts working.  If he doesn't start working after a certain amount of time he gets his driver's license revoked and then goes to jail.

  8. depends on what state you are in. some states issue a cash credit based on whatever deemed necessary, then recoup that from the father whenever they catch up with him.

    other states divy the money as they collect it which means if they dont collect, you dont get paid

  9. Child support is based on the income of both parents.  The court can order the father to find a job but if he doesn't want to work chances are, he's not going to find a job.

  10. You won't get anything but the clock will start tolling on what you can collect for back child support.  That way if he ever inherits money, gets a tax return or a job it will go to you first.

  11. if you are in the united states check with the state child support department. if he makes nothing, then it is true that for the time being you will get nothing. HOWEVER you still need to get the ball rolling. if he ever gets a job, or files taxes, you will get your full backpay from the day that they set an amount. in illinois, where i am they passed a new law last year. if the father /mother doesn't have a job to pay the support owed , they have 30 days to comply, or lose their license. im not sure if that is the way with other states or not. whatever you do , don't wait to apply/file for child support. do it now, even if he doesn't have a job. i know if he in "arrears" (back child support) he will be put in jail, after a period of time. that is a governmental law, not a state one. mabey it will prompt him to get up off his ***.

  13. Before reading all the rest, check with a lawyer. I do know in South Carolina, even though the father isn't working, you will  get  something. They will go after him and he'll work for the state to pay support. Don't be foolish, see a lawyer first!

Just because he is unemployed he won't get out of anything.  He will still be required to pay SOMETHING.  Usually the state min. which is min wage with a 40 hour work week, & that number will be used as his "income" to figure what he has to pay.  However, even though he is ordered to pay that small amount, you may not get it.  Being unemployed he will have to find a way to pay it, otherwise it will rack up as back support until he does find a way to pay it.  And once his back support balance gets so big, they have all kinds of penalties that they can assess on him.  So he will be ordered to pay something.  If you simply wait until he does get a job, then you file, you may or may not get any money from now until then awarded to you.  If you go ahead & file now, you may not recieve the money now, but you will get it eventually.
