Child support, can they even do this??? PLEASE HELP ASAP!

Ok, So I went to court yesterday for an order of support to have my boyfriend pay 12 a month for our daughters medicaid. Well when I went in the family support people [who were saying they were there on my behalf] said they would also be seeking 245 a month in child support...which I had said on multiple occasions I did not want, even signed a court paper saying I did not want it. Also, in Michigan I am not legally obligated to seek child support as long as I am not recieving any public assistance beyond medicaid which is separate. Then the judge said due to the fact that my boyfriend has a domestic violence conviction [long story, to make it shorter, we got in an argument last year, we were yelling, someone in the neighborhood called the cops saying people were arguing, the cops came, he was already gone, they filed charges anyways, they found him guilty even though I said in court we only yelled at eachother and then he left for a while and the police report even stated there was no evidence so now he is on probation for 2 years...also no complains prior to or after that one incident] they have reason to believe I am being coerced into saying I do not want child support and that they would order it anyway. Can she even do that when it is my legal right to refuse child support? Isn't she overstepping her boundaries and isnt there something I can do to reverse the order? Please help I only have 6 more days before the papers are ordered and I can't do anything at all.

  1. If you dont need the money, then just put it into a savings account for the child, since its for the child.  That way you have college money saved up.  The court can order childsupport if they want to.  It does not matter what you signed.  


  2. Child support is you child's right,not yours.If you don't need it, which I doubt because you are seeking medicaid,then put it into an account for your kids for collage.but you are not being a responsible mother if you don't seek what is rightfully your child's on her behalf.

  3. I was told that even with the state law of not being required for just medicaid they can still go after the other parent for support and refusal could cost you any assistance at all.  You can bring up the fact that you only want medicaid and nothing more and that you really don't want the support but in the end if they feel your child is being denied the right for extra support they can still file on behalf of the government that is helping you.
