Child support from an out of state father?

I'm considering appliying for child support when my baby is born. I live in wisconsin and the father lives in Illinois. How do i apply for it ? do i need to drive way to illinois or can it all be done by mail and phone & how would court hearings and paternity testing go. Have anyone been threw the process with an out of state parent? Also, he told me if i'm planning on putting him on child support how we midas well stop talking now and how he'll just take me to court for full custody and how child support is for bums and greedy women wanting money.

  1. actually he is pretty d**n stupid if he is saying that about child support... it is there for a dead beat parent who does not want to cough the money up on their own to be sure the child has everything it needs.... thus is why people have to go to court and do it (sorry that really ticked me off LOL).... go to your family court in your area and talk to them about how you should go about this....  states have different stipulations on how something like this would be handled.


  2. No, you first have to prove paternity.  In the state you are in. This could cost you but you can get legal representation for free or for a reduced cost if you can't pay.  Call legal aid or see if Planned Parenthood can give you names of laywers who do pro-bono work.  

    I think you can file for child support ~ without proving paternity but if he protests then you have to prove it.  Look on the internet under State Government and see if there are forms to fill out to GUARNISH CHILD SUPPORT.  Just google it and you should find something on it that will lead you to what you need to know.

    Don't let him threaten you.  He will never get custody.  He's just trying to scare you off.  You have rights ~ your baby has rights - He owes you at the very least CHILD SUPPORT for his child.  

    Haven't been through this, but there is ALOT of help out there from the STATE WELFARE department - go down to yours and begin the process as soon as the baby is born.

  3. no you do not have to go out of state if you file the papers 1st but if he goes to a lawyer where he lives that lawyer will file paper and get a court date for him then you will have to go where he lives so its just who ever goes to a lawyer 1st!!!

Contact your local DHS (Dept of Human Services).  They will guide you through the process - or Friend of the Court.  You won't have to go out of state.  And, the court almost always gives custody to the mother, unless you're proven not fit.  It's a long battle anyway.  And the father is just threatening you... he obviously just doesn't want to pay child support.  Child support isn't for greedy women - it's for children.  You didn't get pregnant on your own and it's not just your responsibility to support that child - financially or any other way.  I've been through it - I started the process the week my daughter was born and it took 7 months before we were even scheduled for a DNA test and then a few more months before a support order was put into effect.  I got the first check just before her first birthday.  That was in early March and so far it's the only time he's paid... we're going to court again next month.  It's such a long process but go for it.  Your child is entitled to support from BOTH parents no matter what.
