what happens if a person owes back child support and they are on ssi. do they still have to pay the back child support.

    They can garnish 100% of your tax return

    Garnish regular wages, but not all of course.  

    Lottery winnings (that is why it take take a few weeks to get the big win)

    Child support arrears follows one to the grave.

  2. Yeah, there ya go. Take every last cent. Why people have even bother to have kids is beyond me. I've seen this same type of thing so very many times. If he cannot pay, then get a job, and support them yourself. Many others have done it. Why not you too?

  3. He would still owe for it - but it would not be collected out of his SSI.

    It could be collected from any windfall income he may get - such as inheritances, lottery winnings, etc.

  4. From my experience, no matter what your circumstance, you always owe any child support due. Even if you are put in jail for not keeping up with payments, the amount accrues and when you get out of jail, even if you lost your job because you were put in jail, you owe the amount from when you were put in, including the new accumultated amounts. If you are retired, unemployed, collecting social security you still owe child support in the amount set by the courts, until a judge rules in your favor to reduce it. You could be in a coma in a hospital, and unless a judge rules you no longer have to pay, it contiues to be a debt. Not fair to Dad's finding themselves unemployed, overtime cut or having health issues, but it is what it is until enough people protest and a better system is created.
