Child support when the father is in prison?

I'm having a baby in October. Unfortunately the father of my child is in prison for the next 10 years. So heres my question: how do I collect child support? Also, if I were married to someone in prison, would I still be able to collect government benefits for single moms and/or child support? I live in Florida. Thanks

  1. I was just reading your other question about how your boyfriend is going to be in jail for the next 10 years which I thought was a bit much for the affence you said. If thats what he done. I live in Australia and here single mothers with the father of their child in prison do get paid government payments not as much as a single mother here are the rates $472.80 Partnered but separated due to illness, respite care or prison. Single parent $546.80*. Every fortnight payment but once you start earing income the payments are reduced. I think the payment is up until the child reaches 8. Once again this is in Australia so I'm not sure about America they might have similar rules. Good luck hope all goes well.


  2. i know what ur going through my 3 youngest childrens father has been in jail for 2 years and they want to deport him. unfortunatly there is nothing that u can really do about colllecting support unless they put him on work release and yes u will beable to get benefits no matter what state u live in. the state assistance office will make u file for support but u can get help. hope my info helped u out.

    You won't get a dime while he is in prison!

    You can collect any kind of government assistance if you were married, single seperated.....and being in prison doesn't matter.  The only thing that does matter is if your income along with whoever is LIVING with you falls with in the guidlines of the assistance.

It is tough to garnish the wages of someone who is not earning any wages.  If he has anything of value, or money in a bank account you may have a shot.  But it looks like a long shot.  Your best bet is to cut all ties and have him sign away all his parental rights.  Introducing your 10 year old to their dad fresh out of the Pen is not a wonderful prospect and garnishing his 1.50 an hour is probably not worth it.  Move on.
