Childrens passport question?

We are getting passports to go on a vacation out of country. My 2 sons biological father filled out the passport permission forms and had them notarized. He signed it with his new last name. He got a name change a few years ago. Well, their birth certificates say his old last name. And the old last name is what I put on their passport applications. Is this going to be a problem? Or will it be fine as long as he signed and notarized the form giving permission to take them out of country? He wont put his old last name on the documents because he says that his new last name is legal.

  1. The applications MAY get kicked back because his new last name doesn't match the name of the father on the birth certificates. You need to call the passport agency and ask (phone numbers via www.state.gov).  Call the office of your US Representative (Congressman) if you have trouble getting the passport agency to answer the phone. At worst, there will be a short delay and you will have to submit an official copy of the court order that changed his name.
