I am 17 and have been emotionally abused for all of my life, and am seeking to move out of the house in which my parents reside in. What are the circumstances in which I legally can do this?

  1. no comment he he ................

  2. Absolutely none.

    Enough money to support yourself

  3. If physical abuse can be prove then CPS can get involved and have you removed from the house.

You can see if you can be emancipated.  You will need to prove that you can be fiscally responsible for yourself and have a place to stay and still intend on going to school, etc...

Seek counseling and see if they can get your parents involved.  You may be able to make the next year go smoother.

Emotional abuse in and of itself is hard to prove and hard to get CPS/courts to use that to get you separated from your parents.  Remember that in a sense you are "property" until you are 18, and that your parents are allowed to use reasonable physical force for discipline, and that they can yell at you and make you do chores and stay home and not go to parties.

I work in a high school and get this question asked all the time.  I also know that the same kids that are asking this are not exactly saints and have caused a lot of the problems that they are having.

  4. Its a quandry.. At 17 you are considered an adult by the Penal Code. However according to the Family code you are an adult at 18. Therefore if you moved out without your parents permission at 17 they could list you as a runaway.

If you live in a city with a decent size department call and ask to speak to a victim services person or crisis worker. They may have options for you.
