Question:

Claiming tax exemption on HRA along with IT returns filing?

by  |  earlier

I am looking forward to claiming tax exemption on the eligible amount of HRA I drew from my previous employer while filing my IT returns. But the TDS certificate (form 16) from my previous employer doesn't provide the salary breakup in terms of BASIC,HRA etc, which is important for claiming tax refund.

So how do I claim the refund in this situation. What are the possible options for me?

-thanks for your time and suggestions

  1. You better ask for details from previous employer. Because its neccesary to Claim HRA. Since HRA calculation needs Actual HRA received from the employer

  2. Dear freind ,

Your employer has provided you the certifictae based on the infomration provided by you and accordingly he has dedcuted the TDS. So this part is closed.

NOw what you have to do is make computation of your taxable income claiming the rebate of the house rent paid by you. There is some calculation which you have to follow.

Add your other source of income (like interest etc and then work out the actual tax liability and for balance money claim for the TAX refund by filing IT return and form 30.

IN case of doubt write back

  3. Yes, HRA must be paid by your employer.

  4. The HRA benefits can be claimed "only" from the Present Employer - in the sense that the HRA claim for the (let us say) April 2007 to June 2007 at one Employer should be claimed (rent receipts produced) with that Employer itself - it cannot be carried forward to the new Employer. The claims from July 2007 to March 20088 should be from the new Employer.

If you have not produced rent receipts and not not claimed HRA benefit from the Previous Employer, there is nothing you can do now. The Section 10 allowances (generally item 2 in Form-16) gives thisdeduction based on actual claims.

Form-16 will not give you pay breakup; it is simply a Certificate to the IT Dept where it shows your FY pay in taxable levels.
