Class action law suit?

have class action lawsuit.abuse of independent courier laws and violation of FMLA. they want to settle out of court.as of this date no offer has been made how long can they drag this out. its been about month and 1/2 since they said they did not want this to go public and they would settle.

  1. You can expect that the settlement will not be reached for some years as others have indicated.  As you have been told the lawyers want to rack up as many hours as possible and the company wants to hold on to their money as long as possible.

    The only way to shorten the wait is to threaten to go public.  If the company is that adamant about not wanting the case to go public than that is a good enough reason to move it along.  However, you must realize that if the parties involved in the class action suit are not willing to wait around for years and are looking for a fast turnaround than it is upto the clients to lean on their attorneys.  The clients are the victims not the attorneys and if you and your fellow followers have a strong case as you state, you can always hire a new attorney to move the case along faster.

    In my opinion, a month and a half is not a long time period to be waiting for an offer of settlement, the lawyer(s) go back and forth between the company until they feel they have reached a fair settlement for their clients before presenting it to the client.

    Thus, as the quote says "patience is a virtue".  The attorney(s) are most likely not pleased with the offer on the table at this time and are renegotiating.  In addition, they may be seeking further clients for the class action suit.  So I would be patient but keep on top of what is going on with the case.  There is no reason that you can not contact your legal counsel at least on a weekly basis to find out what the status of the case is.  However, when a company is in violation of federal laws it is best to wait it out and let the attorney(s) to his/her job for which he/she was hired to do.
