Collection Account on Credit Report: I had a First Consumer National credit card back in 1997 or 1998. Due to their outrageous charges I closed the account. Now many years later (almost 10 yrs) after reviewing my credit report I discovered that I have a collection account reported by Midland for $1047. What can I do to remove this account from my report?

They are reporting this over and over to all three credit agencies with new dates.

Please HELP

  1. You can use credit repair agency to fix your credit - for example this one - http://creditreport.fateback.com - They can clean lots of such bad stuff from your credit report - and do it much faster than yourself, so your credit will go up fast.

  2. if the acct was closed and pd off you will have to open up a credit bureau dispute with the company you will have to contact them

  3. First thing is don't panic.  Midland is a known scam collection agencie.  This debt is well beyond most states SOL for taking legal action (unless it is for a judgment, in that case, some states allow it to be extended 10 years).

Here is a link to find your states SOL

Contact the CRA that is showing this debt and dispute it.  Inform the CRA that you believe Midland has redated the debt in violation of [CITE: 15USC1681s-2]  Ã‚§ 623. Responsibilities of furnishers of information to consumer reporting agencies

Send the dispute letter certified mail/return receipt.  The CRA will then have 30 days to have the debt verified as valid, in which case, Midland will not be able to do so, then the CRA will remove it from your report.

Here you will see who owns the company and what they are up to which is no good.

  4. Ahhh yes, good ole' Midland...the one of the sleaziest debt collectors out there.

They are violating the FCRA and FDCPA by reporting debts that are older than 7 years, and they are just begging to be sued by doing this.

Send all three of the credit bureaus written disputes for each account midland is reporting, stating that the accounts are obsolete (past the 7 year reporting period). If these accounts are not removed, send Midland a demand to validate letter and specifically ask to know the date of first delinquency. Make sure you send all these letters certified return receipt as well.

You might also consider filing complaints with the BBB, FTC, and Attorney Generals in both your state and the state Midland is located in.

If Midland refuses to validate or remove the accounts, you can go to NACA.net and find an attorney in your area. Chances are you can find one to take this case on a contingency, as they will simply bill Midland for their legal fees if the case is won.
