Question:

Coming to American from Mexico?

I am looking for someone that can help us answer some questions about immigration from Mexico. My friend's husband was here illegally but went to immigration on his own to start the process to become legal. He has been told that he was not eligible for a waiver because he had returned to Mexico in 1998 and back to US in 1999. Since he entered illegally twice he can not even get an interview. He is a great guy with 3 kids (the youngest being 5 wk old twins.) If someone knows that the next step should be or anyway for him to appeal so he can come home legal, please let me know.

  1. I applaud his efforts to try to do it legally. Problem is that he did break the law. He actually did it twice. He tried to do it right to late. Illegal immigration is no joke. It is killing our economy and tearing or society apart. Just because he is a great guy with kids does not mean anything to INS or the average tax payer. He should find himself a good job in Mexico and be a great guy with young kids there.


  2. It sounds like he entered illegally after a deportation.  He may never be permitted entry into the United States.  Usually, there is a period of years that he is not even allowed to request re-entry.  

    An attorney may be helpful, but your friend needs to know that it's unlikely that he will ever be readmitted, and certainly no time soon.  Their family should have a secondary plan such as relocation to his country.  It wouldn't hurt to start the paperwork rolling on this in the meantime if they want to keep their family together.

  3. He may need to hire a lawyer that specializes in immigration.  It's going to be expensive and he needs to be careful b/c there are too many individuals that claim to be lawyers but they only rip people off.

  4. He needs to return home, take his family with him and never return!!! If he was such a great guy, he would have never came here illegally in the first place, no excuses what so ever for his criminal behavior.

  5. In my opinion, Mexico is a much happy country to live in than the US, why doens't  your friend bring his children to Mexico? I'm sure everyone would be happy then.

  6. He is going to have to get a Deportation lawyer. My husband is in the same situation, we are going to have to claim hardship. It could help I was told to get letters from churches he attended or employers that can account for his good character.  Have they filed his I-130 yet?
