Communication Major work in US?

I have a frined who is here on a visiting visa for 1 month and wants to work here permanently. What are the steps that he needs to take? He already has a possible job lined up and he has a BA Degree in communications.

  1. To qualify for an H1-b visa, he needs not only the degree, but also a minimum of 2 years experience.  Then he needs to find an employer to hire him who is willing and able to apply for an H1-b visa for him.  The visa is for a maximum of 3 years, and can be renewed once for up to 3 more years.

    No company can apply for H1-b visas right now because this year's visas are already allocated.  Any company has to wait now to file an application after October 1st for the 2009-2010 allotment.

    Also, on a tourist visa he is not allowed to work or look for work or do anything which indicates an intention to remain.  Tourist visas are only for tourists/vacations!  He must return home.  There is no way whatsoever that he can remain in the US on a visit visa or change status from a visit visa.  Furthermore, any attempt to remain in the US constitutes immigration fraud.  The warning is right on the application he signed, and the fine is $10,000 plus bar to re-entry.

    He must go home!  Then he can send resumes for any job openings.  If a company is interested, they can hire him and apply for a visa for next year.


  2. Well he would have to go to immigration to file the paperwork for permeant citizenship. He would have a better shot if his visa wasn't for just a month, because that type of paperwork takes months to go through so he might be rejected.

  3. Just tell him to do like everyone else does and just over stay his visa.  Then, in a couple years (if he's lucky) Homeland Security will come and cart his a@@ of to jail and then deport him with a federal offence under his belt.

    Look, there is a process for immigrating to he United States, and it has nothing to do with a temporary visitation visa.  The him to go back home and get in line just like every other law abiding citizen in his homeland.

  4. He needs to find a company that is willing to sponsor him work visa (H-1B).  But I believe the quota has been met for this year.
