I AM AN HGV DRIVER AND MY COMPANY AS FETCHED IN A NEW RULE BANNING US FROM USING HANDS FREE DEVICES AND BLUETOOTH TO COMUNICATE,THIS IS NOT ILLEGALL JUST COMPANY POLICY,THEY SAY THEY WILL DO RANDOM CHECKS BY RINGING US AND IF WE ANSWER THE PHONE WE WILL BE SACKED. DOS ANYONE NO IF THIS IS LEGAL OR IS IT FOR EXAMPLE ENTRAPMENT ? IF SO WHAT CAN WE DO AGAINST IT ?

  1. There is nothing you can do except  go by the rule or get another job. Sounds like excellent rule to me.


  2. If your company brings in new rules and regulations, you have two options:

    1)  Comply with them.

    2)  Leave and find another job.

    It's pretty simple, really...

Hi Splurge, also an HGV driver - get another mobile but don't give company the number. what does union say anyway? bear in mind that they may sack you for gross misconduct against health & safety regs so maybe not entrapment. I guess they can't sack everyone or they have no business, or maybe business is going down the pan and if they can sack people they don't have to pay out redundancy money.

  5. I think it's an excellent idea.  Using any electronic device like a phone, is dangerous.  Although it's still legal to use handsfree devices, studies have proved that these cause just as much distraction - and just as many accidents - as using a regular phone.

    Obviously, your company takes safety seriously.  If you want to use electronic equipment, pull over - it could save lives.

  6. Please don't shout. No, it's not illegal. The company can make almost any rule it likes. And if they say NO electronics to be used then that's that. You don't like, leave.

    yarh i think it is like entrapment, go see a soliciter about it, just a concolation, should be free and they can tell you what they make of it

  10. Your company has more sense than the law makers. The distraction of a mobile phone is not the holding of it, but the conversation to a remote person. This is peculiarly distracting as compared to talking to another person in the car, and I hope that studies will soon prove this conclusively and lead to the complete ban of phoning while driving.

  11. If you are employed by a company to drive their truck, they can define whatever rules they want, so yes it is legal. Your only options are to switch the phone off when moving and let voicemail handle the calls, or if many of you are affected make a mass protest through your union. Since recent events suggest it can be a safety issue I would comply as I think you would have a hard job claiming in industrial court
