hi everyone,

a girl which assaulted me was sentenced to an 18 month conditional discharge and ordered to pay compensation to me, 3 months into the discharge she committed a further offence of intimidating a witness, she admitted guilt to the police and was charged, it went to court and she initially entered a non guilty plea in...she elected to go to trial at crown, but on the first day did a plea bargain admitting to a lesser offence of Fear of Provocation of Violence...after wasting everyone's time she is now due to be sentenced for a much lesser crime...under the circumstances, what kind of sentence could I expect her to receive? witness intimidation carries a custodial for 5 years whereas fear of provocation of violence holds only 6 months and a maximum fine of £5000???????

  1. It  is still going to depend on the pre sentence report,  the probation department will do a pre sentence report, and give it to the judge, that is the greatest factor in any sentencing,  usually the judges go with the recommendation, unless they feel the recommendation is so far off that they just could not feel comfortable with it,

there maybe things about the girls history or her circumstances that you dont know that can effect her sentence

    good luck ,  ;)
