Condo Association disrupt tenant light service and promise to return service back only if access is granted?

Tenant has lived in my unit for 4 months, she is owning 3 months rent, she has been evicted but refused to move-out 3 weeks ago, Tenant refused The condo Association entrance almost 2 months ago to enter her unit and check for the fire hazard as a result of smoke coming out of her unit a/c terminal and sparkling and fluctuation of light from the switch board. after numeriuos attempt, tenant refused landlord entance and treatened to sue , The assoc. to protect the lives and property of the residents of the Condominium, notified The landlord of immediate dis-ruption of services if Tenant refused them entrance. Tennat still refused , the association called Comed, but Comed replied that the Tenant has never applied for services and that the account is not on any person's name, as such they can do nothing, the Assoc. then disrupt her light service although she has moved all her stuff out but still refuse to handover keys to me, Tenant filed motion against me instead of Assoc. what next ?

It is not possible that she was evicted and is still in the unit.   You are misstating facts.  Go evict her legitimately and your problem is over.  Also, you have the right to enter your unit over her objections if an emergency exists(fire hazard).  Who does Comed send the bill to or are they giving away electricity these days?

    Your whole question makes very little sense.

    By the way, the condo association is doing a "constructive eviction" by shutting off the electricity and could put themselves and you at the wrong end of an losing lawsuit.  Somebody ought to get their head screwed on straight!!

    At this point, your defense relies on the fact you had no control over the HOA, you did not approve of the HOA actions, then push that the tenant's damage is minimal at this point, she has not paid rent for three months, she has basically moved out, you are just seeking possession, you personally have done nothing illegal and do not condone the HOA decision

    Did they cut all the power or just the breaker that had the a/c on because of the fire, that may get you a little way with the judge if there was a legit fire issue with the circuit that the tenant refused to allow the HOA to fix, and the potential fire hazard to the whole condo

  4. Who cares.  Prepare a counter motion GO to court, and hand it to the clerk.  Ask for back rent, damage, and loss use of property.  

    The association was correct in cutting electricity - she represented an imminent risk to life, and property.  I an unsure why you did not have the sheriff, or constable physically move the tenant out after she was evicted.
