Confidentiality breach by insurance agent. What to do?

My fiance got a car last year. He went with the same insurance broker that my dad has. The agent has a friendly business relationship with my dad. My fiance dropped the insurance and went with another company. (cheaper rates) Anyway, my fiance was involved in a minor car accident. In the midst of getting his car towed away and exchanging information with another car involved in the accident, he accidentally had given the other driver his former insurance card. Within a few hours, he realized what had happened and he called the guy and gave him the correct insurance company info. The accident was completely taken care of by the correct insurance companies involved, but since the other driver went to the hospital ("muscle spasms") the hospital must have used the wrong insurance company to file the claim with initially. Eventually this was all straighted out.

Anyway, today, my dad went to pay his insurance and the insurance broker told my dad that my fiance:

  1. Since all was taken care of properly insurance-wise, I don't see that this is worth pursuing.  It doesn't sound like your fiance is damaged financially by this alleged confidentiality breach.

Interesting.  I don't know the legality of it, but the 'old' agent isn't his agent so I don't see that he has any obligation to not tell someone about something that is in regards to someone who is NOT a client. It'd be one thing if he was a client and told your dad who was also a client.  Bottom line is that your fiance isn't this guy's client so what is he doing wrong exactly?

    The guy's a jerk though...no jury needed for that.

  3. This isn't a breech  of confidentiality.  This is slander.  This guy didn't KNOW for a fact, what he said - he just did the gossip thing, and blurted out the worst case scenario.  

    If you complain to the insurance commissioner, I don't think anything will happen.  If you have a lawyer write and threaten a lawsuit for slander and defamation of character, you might actually get a response from this agent.
