Confused about auto insurance claims...need help....did not have insurance coverage at time of accident.......

I was rear ended and pushed into the back of another car. The adjuster came out to inspect my car...he said that I can have my car totaled out or have it repaired, so I chose to have it repaired. He then told me to call and give the information of the auto repair shop that I choose. I did this Friday and called yesterday and I was told by another representative that they wrote my car out as a total loss.

Now I am confused because he also said that they were responsible for 100% of the rear damages and for 30% of the front damages.

Now if they totaled the my car out, why is he still telling me that they are responsible for whatever damages?

I try calling the assigned adjuster by leaving messages and he is not returning my calls.

There is no engine damage at all. Everything under the hood is good. The car starts and still runs smooth. Major damage to the rear, minor damages to the front of the car. Airbags deployed...

The auto repair shop that I chose said that my car is repairable.

  1. they evidently went back over the damages and found them to be at such a percentage that they deemed the car totaled.  they are telling you they are responsible for the 100% rear damages because their insured rear ended you and for 30% of your front end damage because their insured hitting you from behind caused your auto to be pushed into the one in front of you.  you are 70% responsible for the damage to the front of your car because you should have been a safe distance back. ( in know who ever is right?)  keep on top of the adjuster as he is the one who can help you with all this


  2. If the damage to your vehicle exceeded 70-75% of the ACV, then the vehicle would likely be totaled.  You can buy the vehicle back, but the adjuster will deduct the salvage value from the settlement.   You will need a salvage title, and the vehicle will have to be repaired and reinspected.  

    It sounds to me that they are assessing some comparative negligence on you(30%).  If you were in fact stopped, they should be paying 100% of the ACV.  You need to discuss this with the adjuster.   Ask him/her to discuss their liability assessment.  The driver in front of you must have told them they felt two impacts.  

    Ask to speak with a supervisor if you cannot get in touch with the adjuster.    Don't go off the deep end, remain calm.
