What is the power that the judicial branch holds over the legislative branch?

  1. Trick question.  The judicial branch is in Article 3 of the US Constitution.  The most important power the federal courts have over the legislative branch is the power to declare a law unconstitutional and therefore void; however, that is not found expressly in the Constitution.  That power is found in the case of Marbury v. Madison.  


  2. Article III, Section 1 and Section 2 list the powers that the Judicial branch has.
