Constructive dismissal local council

I have worked for a local council temporary for over 5 years I have in that time received continuos harrassment about leave time down to basic jealousy Race remards about my Gf I have reported this to the point where they would have taken it further but it was my word against theres and It was reported numerous times to my line manager that was 3 years ago and its stopped since I have continusllly asked fo rhelp with work but got no straight answers My contract was photcopied and passed and Emailed data protection act broken at least 6 times 1 person looked witout authority and was stored in an open office in another building . I went through all this with my boss and was told these things happen they were only helping etc I constantly tried to get work sorted not filled in correctly and about health and safety I ahve been moved to different desks and other offices as of now and treated very badly New people arrive and get the nicest treatment and we are moved or share desks when we need them to do our job and then after a short time they start harrassing them as they are temp staff

3 people are getting similar treatment I try to explain to my boss but get stonewalled as the boss protects the ;'' line managers '' coz they are freinds I told the truth and never lie she knows that but I get no supoort Girls have gone home in tears We ahve 1 guy who does nothing but he gets away with everything and passes work onto others as he is assistant supervisor and came to us as a stressed out person anyway Its down to 2 people a made up office manager which has gone to her head and the guy just tittle tattles to her and they cause trouble for everybody because they have no experience or man management skills compared to us 1 lady was a bank manager so the office manager is scared to death she will take her position but she is not interested anyway I am not in a union I cant afford to pay the monthly rate as we are on low salaries And for me 5 and half years as a temp is ridiculous I have put up with the job as its near home Its not rocket science and easy But they just seem to want to create more work and go as slow as possible and dont like when we try to use of initiative either its an absolute disgrace and they get praised all the timeBut nobody knows the reality and nobody backls me up I am on the verge of quitting and then change and carry on But it gets worse and petty everyday Putting Cc into Emails trying to look in charge and making out general complaints then emailing to us as if we cant do our jobs and they are the ones who make the mistakes and do nothng about it when we tell them Just make me out as trouble causer

The first Answerer is actually quite correct - it can't have been that bad if you lasted five years.  To have a good case for constructive dismissal you'd have to have been there a relatively short time, or prove that these things that you're complaining about had only recently started happening.

    Given that you've written that entire diatribe with no punctuation it's actually very hard to understand, but from what I can understand it appears that you would have no case for constructive dismissal anyway.  The definition of constructive dismissal is that you are forced into resigning.  Doesn't sound like that's what has happened in your case.  It just sounds like you've become a bit pissed off with everything, and that's perfectly normal when you've been with one employer for five years.

    Now, with regards to you being a temp, my understanding is that after you've completed a one-year ongoing term then you have full permanent employment rights - this is a UK law; it is not just a policy that some organisations have.

    If it was that bad why did you carry on working there for 5 years when there are thousands of other jobs you could have done.

    The trouble with you public sector workers is that you all moan and gripe and yet you all have virtually guaranteed safe jobs away from risk of private firms where you actually have to work and make money to survive.

  4. I'm sorry, but its actually quite difficult to work out exactly what you are saying due to lack of punctuation and long sentences.

    I would seek advice from ACAS, as I am not 100% sure of your rights as temp staff.  Why don't you also try talking to the agency that you are placed there with?  

    In the meantime, make sure that you do your work correctly and well and keep a paper trail in case you need to prove that it is not you that has messed up.
