Consumers right? cruise holiday, Help!?

I had booked a two weeks Western & Eastern Caribbean cruise holiday last August. Due to Hurricane Dean the company cancelled the Western itinerary so subsquently we ended up two weeks in the Eastern Caribbean (same ports of call, boring), the company failed to inform us the changes before departure, we didn't find out until we reached Ft. Lauderdale. After much complaints the company only offered £100 compensation per person.

Is this a fair offer.....for the violation of my comsumer's right and the lost of enjoyment, bear in mind we paid over £1,600 each person for this holiday!

Should I take them to the small claims court for a better compensation and how much should I sue them for and how much would it cost me?

  1. It wouldn't surprise me if there wasn't something in the small print saying that destinations may change due to weather, as it is well known resort for hurricanes. Check this before you persue anything, £100 is a bit of an insult not even 10% of the cost.


  2. There is something in the small print about weather. Why bother the east caribbean is far superior than the west side.

  3. travel companies usually have ways of getting round such things, usually in the form of small print relating to changes in schedule due to weather conditions.ask them for a copy of the holiday terms, if there is no mention of weather related amendments or it says that you will be offered an alternative holiday, a refund etc before you go, then i would say take it further. you should aim for 50% compensation as you only got 50% of your holiday
