In Texas is there a time frame for one to contest the adoption once the judge has finalzied the adoption?

  4. Okay, ignore all the above answers... they are incorrect.

    In Texas, a biological mom can sign the consent to adoption/termination of parental rights papers 48 hours after giving birth. (That is the EARLIEST she can sign; she can sign later if she wants.)

    Once the papers are signed, there is a 10 or 60 day revocation period in which the mom can change her mind and revoke her signature, IF the relinquishment was handled through a private attorney. (The length of time depends on what kind of affidavit was used.) If the mom relinquished through an AGENCY, she has no revocation period... the termination of her rights is complete as soon as she signs.

    An adoption is not FINALIZED until well after the termination of the bio mom's rights, and NO, the bio mom can't get her child back once the adoption is finalized.

    I've been scouring a couple websites to find out if Texas has any provision for a bio parent to contest a finalized adoption if the termination of rights was illegal (done under fraud/duress) and can't find anything.

  5. before an adoption takes place the parents rights are terminated, that is the time to contest. Once the time limit to contest the termination is over then an adoption hearing is scheduled. so its quite a bit harder to contest the adoption.  Unless it s a case as to why a person feels this particular family shouldn't adopt this child.
