Continued about car accident.?

car 1 at blinking red light, stops looks around proceeds with caution and car 2 comes around corner head on into car 1, however, car 2 does not stop and goes around corner and comes back parks car and talks to police. why did police not ask for stmt from car 1 and car 2 states after being hit she was confused and went around corner and came back. Police in report cited car 1. why?

Because driver of car 2 probably told police that driver of car one did not stop at all and just kept going through the blinking red light.  I don't know why the police didn't take a statement from car one and why driver of car one didn't give a statement.

Ultimately, it is still up to the insurance company to assign fault, provided both drivers have insurance.

Either they knew the person in car 2, or car 2 had a blinking yellow light and the right of way...
