Contractor refuses to correct uneven floor?

CONTRACTOR IN TRYING TO FIX BUCKLED FLOOR CREATED AN UNEVEN FLOOR. WHAT WOULD YOU DO IF THAT HAPPENED TO YOU?

still under warranty.

  1. Contact the Better Business Bureau & The Consumers Protection Board in your state. File claims! Trust me it works!

  3. You don't want to hear this right now (I know! lol) but the "buyer beware" adage could be a winning legal defense for your contractor. Is the warranty for the wood they placed or, somehow, for customer satisfaction?

    Perhaps getting negative word out will help you.  Posting on sites like this is a good start, but like the poster above said...the web is forever.

    I recently renovated my apartment here in nyc and one of the subcontractors made three different mistakes on the wooden floors over the course of the project.  I'm patient (and wouldn't ever sue unless it truly couldn't be settled).

    I know it's after the fact, but always hold a percentage of the payment until you are satisfied.  Put it in the contract.  If they won't agree to that, it doesn't show much confidence.  Since I had some leverage with the remaining balance, the contractor hired another flooring company to make it perfect.

  4. It was probably uneven to begin with.  Could be why it had buckled.  You should've told him to make sure the floor was even.  If you didn't, then I'd say, he did his job.

  5. Well, the Legal Action idea could work. I'm not that type of person. Since you asked what *I* would do, I would post over the internet and spread the word about it and if he has no business, then he has no work, and nobody would be hurt the way you were. If you spread it on the internet, then a lot of people would find it. (lots of internet users in 2008)

  6. send ur request in writting to him.give 10 days to fix job.....then report him to the contractor board of ur state... he is lic. i assume?  and u did check to see that he is lic.?  then ur only choice is to sue him in small claims court.....
