Question:

Cop didnt make me sign the ticket saying i had to show up in court. can i get out of it?

i basically got a ticket he put all the info down. he didnt put the model of my bike just the maker. and at the bottom of the ticket were it says "without admitting guilt, i promise to appear as directed herein." and its not signed cause he never made me sign it can i get out of it?? and he forgot to check my motorcycle endorsement.

  1. Not required here. In fact, as a habit, I don't have people sign tickets. It cuts down on argument roadside. Nothing in Missouri law requires a citation to be signed and I have the judge's blessing on not having people sign.

  3. Don't listen to a 13 year old. You have a chance to beat the ticket on a technicality. But do get your endorsement. You also may want to talk to a lawyer.  

  4. of course i am 13 but i am taking law studies and u dont have prof u promissed him that in court u have to sighn then show if not u have no prof so yeah also if they give u another ticket for not sowing up u go to cort show them the ticket show them that it is not sighned and thats it

  5. The model thing, no chance.  It is not required.

    The signing issue; it could be one if you choose it to be.

    What do I mean?  If you do not go to court the officer will realize that you did not sign which he probably already did and just get a magistrate summons for you and you will be served.  If this officer is good at his job then you will be receiving a summons at your door any day now and the problem will be taken care of.  The officer can obtain a summons and just nolle prosse, or get the ticket dismissed, by the judge in court.

    So, either way, your best bet is just go to court and don't make it hard on the officer if he doesn't get a summons issued for you anyway first.  This will keep you honest and you can point it out to the judge at the hearing.

  6. Like Kenneth there is no requirement in my State (NC) to have you sign the ticket.  Very few Officers have violators sign the ticket and the courts don't care either way.  

    Feel free to bring this up in court but it isn't going to help you.

  7. You signing the citation has nothing to do with the court proceedings.  It is just stating that you received it.  many states, including mine, don't even have a place for anyone to sign.  

    The exact model of the bike is not important, as the driver is the one committing the violation, not the bike.
