Copyright law regarding instrumentals used on demo tape?

I have an artist whose demo tape I plan to solicit to local stations, etc. However, we're both relatively new at this and I wanted to know if it would be legal for us to solicit this CD using instrumentals that have already been used by other artists. The artist paid for the instrumentals, but we're in a whole new ball park here.

The original artist gave permission to have the instrumentals recorded for karaoke or whatever. That does NOT mean they gave permission for anyone to record that over again and re-distribute. To keep this legal you will have to get permission from the original artist/songwriter.
