Copyright violated?

Many TV Serials in India, particularly those based on feminine homely affairs continue for many years, are using Hindi movie songs as the background music or songs sung by the characters of serial at various occasions. Do the producers take permissions from the owner of the copyright of those movies/songs, or they need not any permission? if not is it not a violance of copyright?

if they are only using a few seconds from the song, they don't need permission. The general rule is that anything less than 10% of the original work is covered under fair use.

If theyre using a substantial portion of the song and they did not get permission, then they are infringing on the owners copyright
