  1. This is more procedural than legal. In civil and criminal law there are different kind of proving the things.

    In criminal case the guilt must be proved beyond reasonable doubt but in civil case it is not always followed.

    case he/'she is presiding over.

    where a criminal court has a judge & jury  and the judge is bound by law to act on a guilty or not guilty vote via the jury
