This is more procedural than legal. In civil and criminal law there are different kind of proving the things.

In criminal case the guilt must be proved beyond reasonable doubt but in civil case it is not always followed.

There's 12 in a criminal court, 11 in a civil court.  No particular reason, that's just how it works.
