Costody of an infant.?

a friend of mine is going through a big problem. her step daughter who is 17 had a baby and her dad and step mom were going to adopt the baby . now the mother has changed her mind and wants to keep the baby. what rights does the "grand parents have?

the mother is on drugs and (the baby who is 2 months old) has never cared for the baby

  2. i don't know about the us but in canada it is pretty hard to take a child away from the parent.  if she says she will go to rehab, the grandparents have little hope.  grandparent rights are more to do with visitation rights (at least here in canada)

They can go to court to get temporary custody until the father has been identified.  They cannot adopt the baby unless the mother and father agrees or the court determines her to be permanently unfit and takes away her parental rights.  In addition, the court has to determine if the father can be identified and rule on his rights as well if he cannot.  On average, it takes about 3 years.  If the father doesn't want custody, his parents have as much right to seek custody as the mother's parents and should be notified.

    I know 3 fathers who got custody of their kids from drug addicted mothers.  Two graduated from high school this year; the other will graduate next year.  All 3 had to fight maternal grandparents for custody.

  4. They have to take her to court and seek custody of their granddaughter.  She is under 18 so they are responsible for her, but I'm not sure what rights they have over HER child.  If she is truly an unfit mother, custody will not be an issue.  Any court would put that baby in a more suitable home with actual caregivers.

  5. If the baby is born with a drug addiction, the doctors will know and inform the police immediately.  Custody will be taken away and your friend can adopt.  Other than that, there's nothing to be done- mom has rights.

Have the courts do a drug test.  Besides the father the grandparents are next in line if they want to have the baby.  They like to keep the child with the family.  As for the grandparents have them have child serves come over and approve their house and say that it is fit for a child.  But you will have to prove that the mother is unfit to raise a child.  I hope I have helped.  If you need anything else please email me.

Well if you are truly worried about the baby's health there is a lot you can do for her..First take emergency custody..We had to do that with my step son...Next while you have her you are going to have to start building a case..Facts not here say...Call DSS get them involved have mom drug tested...If she is in danger don't give up your are that baby's voice..She is a baby now you can save her from lots of problems..We had a hard time with my stepson he was 6 when we got him and he had just been through so much..He is 14 now and I think some problems could have been avoided if we got him earlier..I will tell you a child will always love there mother no matter what she does to them it is very sad.
