Could Ben sue the WCE for restraint of trade ?

The plot thickens, as charges appear to have been dropped against the

WCE ex-player.

Was Ben set up prior to the arrest.?

Bin a while since contract law but esentially being sacked upon breaking contractual arrangements would come before the consideration of his losses; unless the grounds for sacking were ungrounded. I think WC would argue he has brought the game into disrepute quite successfully, though this may be the AFL's responsibility (in support of any claims WC would use to defend themselves), and if no other contractual arrangements were broken, he would have a case to recover earnings from WC, outlined in his particular  contract which I have not seen, lol. Then again, could he sue the AFL for the excessive exposure to pressure resulting in his innapropriate coping mechanisms... maybe... but I do not think this would be contractual but based upon a civil hearing or precedent from another similar case.  The contract was with Ben towards the Club and not the other way around! Hence the players Union... where are they????

  4. I wish Ben would bugger off he is a disgrace to WCE his team , his coach , his fans. Enough is enough! He isn't setting an example for anybody. He needs to go away for a very long time to avoid relapses. I bet Ben is the reason Judd left.

  5. This is exactly what I thought when I heard the charges had been dropped - could he sue WCE for unfair dismissal?

    However, it appears that he had breached other conditions besides being drug free in the contract and I think WCE have simply had enough of him - he's bad news and even ardent WCE fans and members were saying sack him.  

    It will be interesting to see what comes out in January's court hearing.

  6. Yes he was set up by the police if anyone should be sued it would be them why else would 6 car loads full of detectives be following him.
