Could I get into trouble if there is child p**n on my computer without knowing that it was there?

the police said they saw child pornography that said "14 year old" or something so they took my laptop and gave me a receipt telling me that i need it in order to claim back my laptop. What does this mean for me in the future am i going to go to prison most likely if there is child p**n on it. I am really freaked out and I am very depressed because of it while still taking wellbutrin antidepressants and i feel like ending myself so bad. I never felt like this in a long time. Its been a little over 2 weeks since the child pornography incident and I still haven't heard from the police. you'd think they would of arrested me by now if they found any child p**n but i am still not in the greatest state of mind. i may seem crazy but not crazy enough to look at child p**n.

  1. GET A LAWYER !

    Yes, you can be in trouble. Possession itself is a crime. There are defenses, though, and a lawyer can help you with them. Do NOT talk to the police again without a lawyer present.

  2. If there are dates that are embedded in the logs that show when they were downloaded, and they are prior to when you bought the computer, then you shoudn't have anything to worry about

  3. I don't think they will throw you in jail the first time around(Unless there is alot).

    looking into a lawyer wouldn't be to bad but I might wait until you hear a bit more.

    But you should remember that this is your computer; to them, saying you didn't know about it is like a man trying to fly into the country with drugs and saying he didn't no about it.

    Just stay cool about it.

    It should be fine after a while.

    You'll feel like **** for a while afterward to but it'll blow over

  5. Good news and bad news, don't freak out while you read the bad news. Accident or not if it's on your PC you will be arrested and you will go to jail and bail will be substantial. Child p carries a stiffer sentence then molesting a real child  in our screwed up country.

    The good news, I have had my PC seized they looked it over and returned it (takes about 3 months) But in my case I could have anything discovered suppressed if I had not consented to a search, but then again he moved me to his car to catch me on dash can and I said you can;t search my computer and he stared at me like he was going to beat me up. Of course that dash cam would disappear before a trial. All this because I was sleeping at an interstate rest area all my windows were blocked  and to get Sleepy I was watching a Nick Cage movie (better then Ambien) but it got so boring I started a FTV Josie video which is not p**n just a lovely girl posing topless

    Based on seeing this he decided to check my PC for Child p. Then you start to wonder well what could be on the PC a bunch of people use that computer etc etc I wanted my lawyer to demand it's return but he said don't make waves don't raise suspicion and they will forget about and after a reasonable time you ask for it's return. There is a high test for legal seizure and you didn't really give details. Nowadays it's hard to find CP on a hard drive because of encryption and passwords anyone looking at that stuff is going to be far more computer savvy then the police or he'll go to jail. A typical user has disabled file caching, system restore, uses FireFox with no cache or a sand boxed browser has his drive encrypted, uses anon proxies etc etc - hard to catch so they catch the Joe Smos stupid enough to chat up an underage girl in a chat room.

    If they find anything they send the PC to the FBI for examination if that happens yea start planning the end.  But an investigation costs the police department thousands of dollars. First they will want to see evidence, not just a random picture off a fusker site but a pattern of use. They will look in your cache, your temp folder, maybe your swap file. They will look in your registry HKEY_CURRENT_USER\Software\

    If they don't find anything bad they will return your PC and that will be the end of it. Don't do yourself yet. Line up a source for bail you pretty much need a house to mortgage.

    Don't say anything to the police don't deny your guilt or proclaim your innocence or make excuses as that may hang your defense in the end.  I'd say at least half of the people who get their PC's seized are never charged

  6. Dude dont off yourself! They'll just think your guilty then, and your name will be smeared forever.

    There are certain programs that can be used to determine if the file has been opened or not. If the file has never been opened by you, they'll be able to tell, and that would obviously clear you.


  7. Innocent until proven guilty. What policed do these days, since the system is so corrupt, is they just bully you into saying you did it. And hopefully you didnt cause people who look at kid p**n are nasty. Just get a good lawyer quick, refuse to talk to the police without a lawyer there. And dont let them force you to say you did it. They can't prove that it was physically YOU who did open or dl the file. Good Luck.
