Could the PGA Tour stop the use of the old Ping Eye 2 Clubs?

Clubs with square grooves have been banned for the 2010 season, but the Png Eye 2 clubs are exempt from this ban because of a legal loophole. The loophole is being exploited by Phil Mickelson, the world No. 2 - so can the PGA tackle this discrepancy somehow? Some players say that using the old clubs isn't within the spirit of the game, after all.
