  1. if you don't get a doctor's note i believe you can be fired.  


  2. Depends on the contract and the laws of the state - did you have a doctors note? That could be the defining factor. If you had a doctor's note saying you needed to be off of work those three days, you're in the right - if not, and I know it's a huge pain the tushie to go to the doctor when it's something you do eventually get over, you're in the wrong. Also, did you call in? No call no show is instant firing at a lot of jobs.

  4. In every place I have been employed, if you are out of work for three or more days, you must submit a doctor's note to verify you were indeed too sick for three days to come to work. Otherwise, yes they can fire you for "unexcused absence".

  7. It depends on the reason you were fired. If you did not have  doctors statement and could not prove you were sick, you could be fired. Also, if you have sick days and you have used them all up. you could be fired.

    However, it you have rarely missed work in the last 3 yrs, it seems they would not fire you for being out 3 days sick. I would talk to Legal Aid and get their opinion, Their service is free.

    Just remember that the business may have other excuses for firing you and then you probably would lose, unless it is discrimination

  9. Did call in each and every day you were off? Did you present your employer with a doctor's release? If yes to both, he cannot fire you for that reason. However, if you did not do these things, he considered you had quit without notice and you were legally terminated.

    If you've been with your company for 3 years, and have only used your yearly-allotted sick days (most companies offer 5-10 sick days/year), then I don't see how they could legally get away with firing you for being sick.

    However, if during your 3 years, you've consistently gone over the allotted sick days, and miss a lot of work in general, then your employer could likely make a case for firing you due to "excessive absences" or something along those lines.

  11. Depends on if you followed the absent policy. Did you call in sick. They can fire you for anything, however that doesn't mean you can not sue them, especially since you worked there for over 3 years.  

  12. Yes should you not call in sick, or if you do not turn in a doctors excuse if the company requires as such.  How are they to know you are really sick, or just playing hookie.
