Court order for paternity test?

There are two potential fathers at this point: me or her ex she slept with once during the relationship. The problem is that the conception happened to close between the times I slept with her and he did that once. I have signed the documents at the hospital and my name is put on the birth certificate because I honestly believe it to be mine, but the ex won't give up and demands a paternity test. Can the ex, whom believes that he is the father of the baby, court order a paternity test to see if he is the father after the documents of paternity at the hospital have been signed?

  1. You, the mother or any guy who clams to have a realistic chance of being the father can request a test through the courts.

    By signing the paper, you basically mad yourself the 'legal' father and acepted the financial responsability for the child. So, you get to pay support for the child until you are proven to not be the father.


  2. Yes.  I suggest u all go ahead and do it to get some peace of mind.

  3. She could have put "Sponge Bob Square Pants" on the birth cert as the father. That piece of paper is meaningless where thats concerned.

    What is it he wishes to gain? Will he take an active part in the childs life and pay C.S. as well? If he persues this pat test make sure he pays the cost of it and take him to court to pay C.S for the next 21 years and health and college.

  5. I beleive so.   Don't you really want to know? I know its scary but in reality, this child needs to know who the paternal father is. There could be very important genetic things that need to be known.

Legally an alleged father can REQUEST a paternity test.  However, if you signed the Birth Certificate you and your gf/wife/etc admit to the fact that you are the father and that will actually hold up in cout (in CA).  If the other guy had signed the Birth Cert then he would be able to request this more easily.  

    So for you and your families sake I hope that he does not request this and you continue to be a family!

  7. If there is no paternity paper stating who the father is then yes both fathers can court order for a paternity test.
