Court ordered paternity?

My Brother in law had a baby with in a girl in a different State, we all know he is the father but he doesnt want to have anything to do with the baby. Anyways she went to court to get child support and the court ordered him to take a paternity test and he isnt going to do it ............ what is going to happen to him now ? Will he go to jail for not taking the test ? How long will it take for anything to happen to him since they are in different states ??

If he doesn't have the test done Then he will be in contempt of court and the judge will issue a bench warrant for his arrest.  They wont send cops after him unless the girls lawyer really pushes it.  But the next time he gets pulled over and his license is run the cop will arrest him on the spot and tow his car. Now he will pay for towing and court costs.  Plus he will still have to take the test and if he refuses they will hold him down and take the blood from him. In the end he will lose this fight (unless it is proven he is not the father) So he should be a man and have the test done.  If he is the father he should be a man and take responsibility for it.


  2. He is better off taking the test and signing his rights away than not taking the test at all.  What the first answer said was right...

  3. They will file contempt of court charges and then issue a warrnet for his arrest.  They can then suspend his license and ask to have him picked up in his own state and transported to the state where he has the warrant issued.  So yes he can go to jail until he complies with the court order.
