Credit card in at law firm?

my credit card was in collections and now they have turned it over to a lawyer who says they are about to take pre-litigation against me unless i make payment arrangements? are they about to take me to court or is this another scare tatic from the collection agency?

  1. Did they send you a letter claiming they were going to sue you?  It's very important how the letter was worded, as making a threat to sue you when they actually do not intend to do it is illegal.

    Also keep in mind that a lot of collection agencies hide behind an attorney's name.  One attorney in particular is very good at "selling" his name to collection agencies so they can give the impression they belong to a law firm.  It scares the heck out of debtors to see "law office" on a letter  But the fact is they are only scamming you.

    Will they sue you?  Again, that depends on a few things.  They usually don't sue for small debts under $500, and when it approaches $2000 you can be a target.

    If the agency is in a city near you, that also makes you a target, as they generally file lawsuits by the armful so they can appear at court at one time.  It's amusing to see the same attorney stand before the judge for 3-4 hours while a parade of cases on the docket pass through.  It makes it very efficient for the lawyer.


  2. No its seems you may be getting sued, when they turn you over to lawyers then they are serious, pay your debt!!!!

  3. It depends who the law firm is. If they are junk debt collectors, they are just bluffing. By law, they have to get everything in writing and you can dispute it if possible. Also, how long ago was this debt from? The statute of time limitations might have already passed in your state. By no means should you give them any personal information over the phone because they may trick you. Always get everything in writing.
