Credit card problems...can anyone help?

well i have had some really roughtimes over the past couple years and have let some things slip by to accomidate for other things that are more important!!! I was summands by capitol one to go to court and im afraid of what is going to happen...I really am going through hard times, with helping my dad to financially supporting my 17 year old sister so she can finish high school this year, has anyone else been in this pardicament, or knows of anything that may help....IM FREAKIN OUT!!!please no sarcasim!

  1. Try to find an attorney to help you. Also, are you in A LOT of debt? If so you may need to consider filing chapter 7. This would protect you in court ( they could not sue you and would have to forgive the debt) but it will stay on your credit for 7 years. On the flip side tho, if you don't go bankrupt your credit is going to be killed by getting a judgment against you and it will stay on your credit for just as long. Look into filling and see how much it cost and do it fast, like before you go to court so that when you show up you can show the judge that you are bankrupt. Best of luck and try not to worry to much. You'll get through it and one day it will all be over.

DO NOT be a "no show" on the court date under any circumstances....If you are a no show, the other side will get a default judgement...That means that CapitalOne will get a judgement on THEIR terms...with big add-on fees....You'll be looking at wage garnishment of up to 25% (unless you live in a state like TX or PA that does not allow this).

    At least by showing up you can explain your circumstances as you did above..so that court would give you much more favorable terms.
