Credit harashment.. pls help me, i have to pay due amount to cridit card , somehow they found my home?

phone number and harassing my parents, right now i am outside india, i am ready to pay but it wil take some time ..

she has given her number to my parents. .. i feeling shy to answer my parents... . pls tel me wt to do. how to stop the phone calls. my parents are in terrible pressure.

i have her number can i cl her and tell not to do so. pls guide

  1. by law U have debtors' rights. U CAN tell them 2 Cease And Desist from calling & harassing U. Additionally, pay yer debt when U have the $ & pay what U CAN & no more than U can.

  2. They are not harassing you.  Asking you to pay back what you promised is not harassment.

    Judging by your question, you have taken goods or services and not paid for them.  You should not be complaining about the conduct of others.

  3. There's some easy ways to get them to stop calling you and your parents:

    1) Tell your parents that if people call for you on a blocked number or 1-800 number to say that you're "Estranged" from them and they haven't talked to you in several years. As long as they stick to that story 4 times a day for 2 weeks, they'll stop calling.

    2) Another good trick is to let all those blocked 1-800 calls forward to a voicemail of someone else ie. if it's the Johnson household the voicemail says "You have reached the Smith family"

    3) Make your voicemail sound like it's your primary business line. There's strict rules about harassment at work. If you make your home phone into a business line, they will be unable to call you on it.

    4) Move. They can't send you harassing mail or serve you with sapinas to go to court if you don't have a forwarding address. Oh, and when you move, don't update your drivers license and don't update your bank account with your new address. They can trace that.

    5) Change your phone number!!! Don't have a house phone anymore either. They can trace that. Stick to cellular networks. Pay-as-you-go is ideal.

    So basically stay off the grid. If you're lucky enough to live in Canada, you'll be happy to know you've only got to dodge them for 2 years and they'll stop calling you (Statute of Limitations is 2 years in Canada) if by chance the two years is almost up and they find you, NEVER ADMIT THAT YOU OWE ANYTHING. Say you don't recall owing that money and to forward the information in writing (then change your number again). As soon as you admit you owe money the Statute of Limitations starts all over again.

    What doesn't work:

    - Telling them "so and so doesn't live here" won't work. Everyone says that. They'll call anyways.

    - Telling them "send it in mail form instead of calling" will not work. they'll then send you the mail and then call you 4 times a day making sure you got it.

    And as far as "Well they aren't harassing you they're just collecting money you owe them" this is what I have to say:

    "If I didn't have the money when you talked to me at 9am, I wouldn't have it a 2pm, or 5pm, or 8pm so don't bother calling me 4 times a day every day."

  5. here in North America there are rules pertaining to collection procedures that must be followed.

       In the case you mention, it would appear that the collector is pressuring your parents in order to get to you. Your parents should just say that you don't live there and hang up when called by the collector.

        I would call up the collector and tell them that they are not to call at your parents and that any further communication is to be done by mail.

  6. I managed a collections office. Here's what you can do:

    1. Your parents need to send them a certified (proof of delivery) letter, in writing, that they are not to be contacted about the debt again. Essentially "We do not owe this debt. So-and-so does not live at this address and may not be contacted at such-and-such phone numbers. Stop contacting us about this debt immediately as required by law." If they call after your parents receive the proof of delivery, they need to talk to a supervisor and state that they know they are forbidden by law to contact them after receiving that letter. If they claim they haven't received it, they can fax it and wait on the line for confirmation. It's worth the time to get them to stop contacting you.

    2. You should contact them and let them know that you're out of the country and will contact them again when you are back in the country to figure out the problem and fix it. If you work with them, they'll usually work with you. Lying to them, denying a debt you know you owe won't help. They've probably got your signature on a contract acknowledging the situation.

    3 - They can only collect the debt for 7 years, but it will stay on your credit report for longer, so you do want to resolve it.

    A few corrections to errors in other "answers":

    1. They can definitely call you at work unless you tell them that it's your work number and it's company policy to not contact you there.

    2. Very bad idea to lie to them or get your parents to lie to them.

    3. According to case law, collection efforts can be considered harrassment if they communication about collecting more than once every 3 days. That includes phone calls, voice mails, letters, and in-person talks. If they call but don't talk about collections, it doesn't count toward this.

    4. They won't stop calling just because they get the same denial for 2 weeks.

    5. If you move, they can find you. It's easy to do if you have a bank account through your credit report or check systems.

    6. "As soon as you admit you owe money the Statute of Limitations starts all over again." is incorrect. If you incur new charges the statue to limitations can restart.
