hi. i just posted today about my ex adding me as an authorized user on his credit card and got into collections and ruined my credit also. thanks for the replies. but i have one other question. i heard that if the credit bureau finds that my ex is using my identity, will that be considered identity fraud? all i want is my credit to be back to normal. i don't want him to be charged for identity fraud. he is still my baby's father afterall. would he be pressed charges against him?

  1. I am not sure but I think you could be charged with Fraud especially if you have been refused Credit because of failure to pay bills.


  2. In order to claim ID theft with the CRA's, so you can have those items removed and a fraud alert placed on your files, you will have to file a police report against your ex. They probably will press charges against him.

    If you don't want to do that and since you were an AU and not a joint user:

    Start by placing freezes on your credit reports.

    Then you should dispute the accounts with the CRA's as "never had the account in your name, please delete it".

    Do it in writing, not online, and send it certified mail (not certified return receipt)

    In a perfect world, the accounts will be deleted without any further fuss. Hopefully that will be what happens in your case.

    But, you may have to take it to the original creditors and collectors, asking them to provide you with proof that it was your account. (in writing, sent certified mail return receipt)

    If that fails, file complaints against them with the BBB, the FTC, your Attorney General and the creditors/collectors AG.

    If the CRA's continue to allow it to remain after your disputes, file complaints against the CRA's with the FTC (one complaint for each CRA), then send in another dispute to the CRA's and and include a copy of the FTC complaint.

    I don't know why your ex placed you on the accounts as only an AU. The creditors do not use the AU's credit history for "anything" that has to do with approving accounts or giving credit limit increases, etc.

    Be sure that you are only an AU and not a joint. If you are a joint you should still dispute the accounts as not yours but it will be much harder, if not impossible, if you do not file a police report for ID theft.

  3. You can use credit repair agency to fix your credit - for example this one - http://freecreditreport.sinfree.net - They can clean lots of bad stuff from your credit report - and do it much faster than yourself, so your credit will go up fast.

  4. As long as this isnt a joint acct your husband should beable to take you off the acct even though its in collections.

  5. No there' s no identity fraud because you are both linked to the same account so that informatin is shared and readily available. Besides the account is in collections so the creditor has reasonable grounds on which to inquire on your credit report.

    For starters just have him take you off as an authorized user. You're not on their for life. You'll still have to take the hit for the collection negativity cuz you were responsible as a user. Just don't share accounts anymore. Keep your credit paid up and on time and to yourself.

    How can your ex use your identity and it be fraud if you're consenting to it?

    Tell him to stop and get it togehter.
