Cricket: BCCI forwarded IPL Chief Modi’s case to disciplinary committee
Suspended Chairman of IPL Lalit Modi has asked Shashank Manohar President BCCI and Secretary N Srinivasan, in writing, for a copy of all verdicts made at the special general body of board on Saturday as they "encroach" on his rights.
Modi's lawyer Mehmood Abdi told media reporters about the letter Modi has written to the BCCI President and Secretary. He said, "Mr. Modi has written a letter to Mr. Manohar and Mr. Srinivasan to confirm that the decision of the Honorary Secretary to refer the issues raised in the three show-cause notices to him and his reply thereof are referred to the disciplinary committee". As revealed by Abdi, the letter was hand-delivered and was sent via e-mail as well on Saturday night.
Charges against Modi were ratified when the Board voted unanimously against Modi at a special General Body meeting on Saturday. Following the unanimous consent, the case was forwarded to the disciplinary committee of BCCI. The unanimous decision authorises the BCCI President Mr. Manohar to file criminal or civil charges, if required, against the suspended IPL Commissioner Lalit Modi.
"The house after a deliberation and debate in the matter, resolved that the President of the Board should be authorised to take all legal actions including civil and criminal for the wrongful loss caused to the Board against Mr. Modi and any other person", said BCCI President http://www.senore.com/Cricket/Shashank-Manohar-c89791. President Manohar went on to say the decision about the nature of the charges, civil or criminal, can only be made after the disciplinary committee completes its investigation regarding legality of the matter.
Modi has frequently laid blame on both the BCCI President Manohar and the Secretary Srinivasan for having some personal rancour against him, and requested that neither of the two should be part of a disciplinary committee deciding his case. The Board accepting his request has replaced Manohar with President of http://www.senore.com/Cricket/India-c750. Late Scindia was the president of BCCI from 1990-93. BCCI vice-presidents Chirayu Amin and Arun Jaitley are the other two names of three member disciplinary committee that will take up Modi’s case. The committee has to complete its inquiry by 26th October 2010.
Mehmood Abdi, lawyer of Modi has called the decision of the Board to look into criminal and civil allegations against his client a "legal absurdity". He said that the case has been forwarded to the disciplinary committee by the special General Meeting of the BCCI for further investigation and at the same time the Board is planning to file criminal allegations against Lalit Modi.
"The decision taken is a legal absurdity", Abdi said while talking to media reporters. "On the one hand the special General Meeting of the BCCI decided to ratify referring of charges against Mr. Lalit Modi to the disciplinary committee for further investigation. On the other hand the BCCI decides also to file criminal charges against Mr. Modi on the same grounds. That means the BCCI has already formed an opinion about the commitment of offence by Mr. Modi".
The meeting was summoned by N Srinivasan, the BCCI secretary. Srinivasan had rebutted Modi's responses filed against all the three show-cause notices of board calling them “not acceptable”. In a six-page letter to the members of the Board of Control of Cricket in India (BCCI), Srinivasan turned down Modi's replies to various charges, saying that the charges need further inquiry and would be sent to the disciplinary committee of BCCI for this purpose. As per BCCI’s constitution, a three-fourths majority was required to confirm Srinivasan's decision. But a unanimous ratification added to the problems of Lalit Modi.
The IPL Commissioner was suspended soon after the conclusion of third edition of IPL and is under investigation for alleged financial irregularities, the sale of theatrical rights and the mid-over ad sales.
