Criminal Conviction?

Having been arrested on Saturday night in my drunken state, do you think i will now have a criminal conviction? As i'm filling out a job application form and it asks whether or not i have had one. I haven't heard anything more from the station and don't really know what the outcome is? any ideas what i should put on the application form??

  1. You cannot have a criminal conviction unless you have been found guilty in a court of law.


  2. To be convicted you either have to pay a fine (such as a speeding ticket) or go to court and have a judge say you are guilty.  It can take a week or a month or more to fully charge someone.  Just call the local police and ask them.

    You should be cautious, and carry on with your application as this never happened.

    Word of advice, PLEASE try not to let it happen again. If you get away with it this time, then good news, but look to your future, and your future job prospects. If it happens again, you may not be so lucky.

  4. Don't mention it, You have not been charged and I think you were more likely put their to teach you a lesson or for your own safety.    

  5. Right now you dont have a criminal conviction as you havent been to court and convicted for any crime. If this happens later then its a different story.

  7. I would contact the Police force whose officers arrested you to ask them what the outcome is.  You haven't said what you got arrested for but if its drunk and disorderly then you will probably receive a fine and nothing else.

    You should have been given some sort of outcome when you were released from Police custody.  This would have been either no further action, a penalty notice for disorder which is an £80 fine or been bailed pending further enquiries in which case the investigation is ongoing.

    I wouldn't disclose anything other than whats asked for on your application form until you know the proper answer.

  8. You will be ok. If it was anuthing serious they would of took you to court prior to letting you out. If no so serious they would of give you a formal caution and then let you go.

    If you were  arrested and read your rights and then interviewed and had to sign a statement you could possibly face charges after the CPS have a look at the case against you.

    I very much doubt it for drunkeness

  9. Don't mention it on the form. You are only considered to have a conviction if you went to court and pleaded guilty, or if you were found guilty by the court, or if you signed a police caution admitting an offence so you didn't have to go to court.

    Such petty convictions are considered "spent" in England after 7 years (some minor offences after 4 years) - and after that time, you can pretend it never happened.

    It doesn't sound like you have a conviction so keep it quiet.

  10. No not a conviction, but; you will have an arrest and booking record.

    Arrest and booking will not show up unless someone is specifically looking for it.

    If officer said would not go to court, why arrested and detained?


  11. You do not have to mention it on your application form, it is when to go to court that is when you have record.They may have arrested you for your own safety

  12. You don't have a criminal conviction until a court has found you guilty. As that doesn't seem to have happened yet, then you don't have a criminal conviction yet.

  13. If you are in the UK, you do not have a criminal conviction. You can only have that by going to court and being punished there. So you do not have to worry. I suspect that you were simply arrested and detained until you sobered up. There is nothing for you to disclose on the form.

  14. if you have only been arrested you wouldnt be lying if you said no conviction, but you would be obliged to tell them if you were subsequently convicted.
