Criminal acts at stores?

Are these shoplifting crimes are not. the criminal acts take place at stores. read below

1) in home alone 2 Harry and Marv hid in a toy house in a toy store and stayed there until the store closed then came out at midnight went behind a counter pryed open a cash regsiter and stole money from the cash register

2) in hey arnold episode cool jerk Frankie wanted to enter through a unlocked back door of a electronics store at night come inside and steal a tweeter from the store

  1. They take place at stores. Seems to me like breaking and entering, burgulary (Sp?), if alarms are set off-breach of peace and who knows what else..you may be liable for civil penalties as well.


  2. Those are not shoplifting, they are burglaries. Burglary is a felony, more serious than shoplifting.

    The door being unlocked does not matter. If you are not authorized in a building, and steal, it is burglary. Shoplifting is when you steal something during regular store hours.

  3. Both of those situations are not shoplifting.  They are instead both burglaries.  The definition of burglary is to enter a premisis with the intent to commit a crime.  (one you are not supposed to be in).

  4. Both of those acts would be considered burglary.
