I have pending criminal charges (felony), but my name was spelt wrong on all the documents.

Does this mean that when employers run a background check on me, these charges will not showup if i am charged formally?

  1. They will show up because your background check will include your social security number and that will show up in a database. Part of the background check will include a criminal history check.

  2. That's not a faux pas. A faux pas is misremembering someone's name when you introduce them, or arriving at a party 2 hours late.

However, employers will look you up by social security number, so no, it won't matter, though it may cause some confusion.

You might be able to get the charges dismissed if you have a good attorney and he can sow enough doubt in the jury that they have the wrong person, but that's unlikely...

  3. They will show up just with wrong spelling.

  4. No.  They run you by Date of Birth, Social Security #, or even Fingerprints.  Not just by your name.  They will still see it.

  5. State criminal histories are based on fingerprints, Your right name will, at some point, be added to the wrong spelling, and fingerprints will keep it all in the same record. And on a check by name and date of birth, the system likely uses a SOUNDEX scheme that will absorb most spelling errors, anyway.

  6. its faux pas. well i dont know, but kudos for you if they dont.
